1. Introduction

These terms and conditions (“Terms”) apply to the Users of the Service (“Service” or “Olivia” provided by Menohealth AB through our Olivia app (“App”) and through the website https://join-olivia.com (“Website”). We who provide the service are Menohealth AB company reg. no. 559221-5007 (“Menohealth”, “Olivia”, “We”). By agreeing to the Terms of Use, an agreement is entered into between you (“you” or “you “) and us. In the event that you do not accept these Terms of Use, please do not use the Service.

2. The service

​

Olivia is a digital service that you interact with to understand the connection between lifestyle and menopause symptoms. Olivia helps you understand which lifestyle habits

can have a positive effect on your menopause.

 

Anyone using the Service or any part thereof is described in these Terms of Use as “Users”, which includes you as a party to the Terms of Use. If you are under the age of 18, you may not use the Service without the consent of a legal guardian.

3. Allowed usage

Your use of the service may only be done in accordance with its intended purpose and these Terms of Use. Provided that you do not violate the Terms of Use, you are granted

a non-exclusive license to use the Service for its intended purpose. You may not assign

the license to anyone else and in the light of the Service being free of charge, we reserve the right to withdraw the license if you breach the Terms of Use or otherwise at our sole discretion.

 

You may not, entirely or partly, copy, modify, decompile or reverse engineer Olivia or any components. It is not allowed to reproduce the source code or its functionality, or to make copies or create secondary work of the software, in addition to what the law allows. 

 

You may also not use the Service to disseminate viruses, Trojans or similar programs,

or to automatically scan the Service (“scraping”).

4. Intellectual property rights

​

All intellectual property rights in the Service belong to us or are licensed by us. Nothing

in these Terms of Use shall be construed as transferring any intellectual property, or other right, to you or anyone else.

5. User accounts

​

To use the Olivia App, you must create a user account with us (“User Account”). When you create a User Account, we will ask you for information about yourself.

 

Your User Account is personal and you may not transfer your User Account to anyone else, or allow anyone else to use the Service through your User Account. You are responsible

for protecting your login credentials from unauthorized access. If you have reason to believe that someone else has accessed your User Account, please notify us immediately. We have the right, but not the obligation, to block access to your User Account if we have reason to believe that an unauthorized person has gained access to your Account, or that the User Account has been abused. We have the right to suspend your access to the Service with immediate effect if we have reason to believe that you violate these Terms

of Use or if your usage violates any law or has adverse effects on the Service.

 

We reserve the rights to close your User Account if it has been inactive for a period of 12 months.

6. Processing of Personal Data

Your privacy is important to us. To learn more about the use of your personal data, you may refer to our “Privacy Notice”

7. Change of Terms and Service

​

We may make changes to this Terms and Conditions. If we make significant changes,

we will notify you based on what is appropriate, taking into account the circumstances.

We will notify you by e.g. announcing on the website, via email or via in-app notification. 

You have the right to cancel your User Account at any time and without prior notice.

 

Furthermore, we reserve the right, at our sole discretion, to modify, cancel or temporarily

or permanently discontinuing our provision of the Service without prior notice, or as required by law or governmental decision. You agree that we are not liable to you or any third party for such modification, interruption or termination.

8. Transfer

You may not assign or transfer any rights, obligations or licenses set forth in these Terms

of Use. We may assign and transfer these Terms and Conditions without your consent

and without noticing. 

 

9. Applicable laws and disputes

 

These Terms of Use shall be governed by and interpreted in accordance with Swedish law, without the application of the rules of choice. 

 

Any dispute or claim arising out of or in connection with these Terms of Use, or in the event of a breach, termination or invalidation therefore, shall finally be decided by a Swedish court, with Stockholm District Court as the first instance, unless otherwise provided

by mandatory law.

This app (“App)” provides only information, is not medical or treatment advice and may not be treated as such by the user. As such, this App may not be relied upon for the purposes of medical diagnosis or as a recommendation for medical care or treatment. The information on this App is not a substitute for professional medical advice, diagnosis or treatment. All content, including text, graphics, images and information, contained on or available through this App is for general information purposes only
